India’s food supply chain is enormous – from street-side vendors to multi-billion-dollar food processing companies, millions of food businesses operate across the country every day. Ensuring that the food reaching consumers is safe, hygienic, and of acceptable quality is a massive regulatory challenge. The Food Safety and Standards Act, 2006 (FSS Act) was enacted precisely to address this challenge by creating a unified, science-based legal framework for food safety in India. It replaced a fragmented system of multiple laws and brought all food-related regulation under one umbrella authority – the Food Safety and Standards Authority of India (FSSAI).

Why India needed a single food safety law

Before the FSS Act came into force, food safety in India was governed by a patchwork of laws – the Prevention of Food Adulteration Act (1954), the Fruit Products Order (1955), the Meat Food Products Order (1973), the Milk and Milk Products Order (1992), and several others. Each of these was administered by different ministries and departments, leading to overlapping jurisdictions, inconsistent standards, and enforcement gaps.

The FSS Act, 2006 repealed all of these older laws and consolidated them into a single statute. It received Presidential assent on 23 August 2006 and was published for general information as Act No. 34 of 2006. The key shift was from a fragmented, multi-departmental control system to an integrated, single line of command focused on science-based regulation and self-compliance by food businesses.

Purpose and framework of FSSAI

The FSS Act established the Food Safety and Standards Authority of India (FSSAI) as a statutory body under the Ministry of Health and Family Welfare. FSSAI was formally set up on 5 September 2008, though its rules and key regulations were notified and it became fully operational in 2011.

Core functions of FSSAI

FSSAI’s mandate is broad and covers the entire food ecosystem. Its primary functions include framing regulations and standards for food articles, laying down guidelines for laboratory accreditation and food testing, and providing scientific advice and technical support to the central government. It also contributes to the development of international technical standards for food, creates an information network for rapid communication about food safety issues, and promotes general public awareness about food safety.

The Authority is headed by a non-executive chairperson (at the rank of Secretary to the Government of India) and consists of 22 members. FSSAI is headquartered in New Delhi and has regional offices in cities including Delhi, Mumbai, Kolkata, Chennai, Cochin, and Guwahati. It works alongside a network of referral laboratories, state/UT laboratories, and NABL-accredited private laboratories across the country to carry out food testing and analysis.

Structure of enforcement

At the state level, the Act establishes State Food Safety Authorities, a Commissioner of Food Safety, Designated Officers, and Food Safety Officers (FSOs). FSOs are the ground-level enforcers – they have the authority to enter and inspect food premises, collect samples for analysis, and issue registrations to food businesses. Their powers in terms of search and inspection are equivalent to those of a police officer carrying a search warrant under the Code of Criminal Procedure.

Standards and compliance

The FSS Act lays down a comprehensive system of standards that covers every stage of the food supply chain – from manufacturing and processing to packaging, storage, transportation, distribution, sale, and import.

Key regulations

Under Section 92 of the Act, FSSAI has the authority to frame regulations consistent with the Act and its rules. After the Act’s enactment, FSSAI drafted six principal regulations through extensive stakeholder consultation. These were notified in August 2011 and cover critical areas including licensing and registration of food businesses, food product standards and food additives, packaging and labelling, prohibitions and restrictions on sales, contaminants and residues, and laboratory and sampling procedures.

Since then, FSSAI has continued to issue additional regulations to keep pace with evolving food science and market trends. These include regulations for health supplements and nutraceuticals (2016), food recall procedures (2017), import regulations (2017), organic food standards (2017), and regulations for novel food approvals (2017).

Licensing and registration

Every entity involved in food manufacturing, processing, packaging, storage, distribution, sale, or import must comply with the FSS Act. The Act mandates that all food businesses obtain either an FSSAI licence or registration depending on the scale of their operations. Food Business Operators (FBOs) with an annual turnover below โ‚น12 lakh need a registration, while those above this threshold require a licence. Licence fees range from โ‚น2,000 to โ‚น5,000 per annum, and the validity period can extend from one to five years.

Responsibilities of food business operators

Under the Act, a food business operator (FBO) is the person who owns or runs a food business and bears the primary responsibility for ensuring compliance. FBOs must ensure that food articles meet prescribed safety standards at all stages – from production and processing to import, distribution, and sale. They are also required to maintain proper hygiene conditions, follow labelling and packaging regulations, and implement food safety management systems as applicable.

Enforcement and penalties

The FSS Act takes a graded approach to penalties – the severity of punishment increases based on the seriousness of the offence. The penalty provisions are laid out in Sections 49 through 67 of the Act, covering a wide range of violations from minor non-compliance to offences that cause death.

Penalties for food quality violations

Selling food that does not meet the quality, nature, or substance demanded by the purchaser attracts a fine of up to โ‚น5 lakh (Section 50). The same penalty applies for manufacturing, storing, selling, distributing, or importing sub-standard food (Section 51). Dealing in misbranded food carries a fine of up to โ‚น3 lakh (Section 52), while publishing misleading advertisements about food can attract penalties up to โ‚น10 lakh (Section 53).

Penalties for hygiene and safety violations

Manufacturing or processing food under unhygienic or unsanitary conditions can lead to a fine of up to โ‚น1 lakh (Section 56). Possessing adulterants that are not injurious to health attracts a penalty of up to โ‚น2 lakh, while possessing adulterants that are injurious to health can result in fines up to โ‚น10 lakh (Section 57). Failing to comply with directions issued by a Food Safety Officer attracts a penalty of up to โ‚น2 lakh (Section 55).

Punishments for serious offences

The Act draws a clear distinction between penalties (civil fines) and punishments (imprisonment). For dealing in unsafe food (Section 59), the consequences are severe and proportionate to the harm caused. If no injury results, a fine of up to โ‚น1 lakh applies. Non-grievous injury can lead to up to one year of imprisonment plus a fine. Grievous injury can result in imprisonment of up to six years and a fine of up to โ‚น5 lakh. If the offence causes death, the punishment is a minimum of seven years imprisonment (extendable to life imprisonment) and a minimum fine of โ‚น10 lakh.

Operating a food business without a licence (Section 63) is punishable by up to six months imprisonment and a fine of up to โ‚น5 lakh. For repeat offenders (Section 64), the punishment can be doubled, a daily fine of up to โ‚น1 lakh can be imposed for continuing offences, and the licence is cancelled.

Compensation for consumers

Section 65 of the Act provides for compensation to consumers who are harmed by unsafe food. In case of death, a minimum of โ‚น5 lakh must be paid. For grievous injury, compensation can go up to โ‚น3 lakh, and for other injuries, up to โ‚น1 lakh. The compensation must be paid within six months of the incident, with interim relief in death cases payable within thirty days.

Recent amendments and their impact

Food safety regulation is not static – it must evolve with changes in food science, consumption patterns, processing technologies, and emerging risks. FSSAI has been actively amending its regulations over the years, with over 80 amendments to the Food Products Standards and Food Additives Regulations alone since 2011.

2024 amendments to food product standards

In October 2024, FSSAI notified amendments that include revised standards for dairy products like khoa and mozzarella cheese, updated ingredient requirements for peanut butter, and refined classifications for olive oil with specific chemical property standards. The amendment also introduced standards for rice and rice flour used in producing fortified rice kernels, along with quality control expectations for vitamin-mineral premixes. Most of these changes took effect on 1 May 2025.

Packaging regulations update (2025)

In March 2025, FSSAI introduced the Food Safety and Standards (Packaging) First Amendment Regulations, 2025, which approved recycled polyethylene terephthalate (PET) as a material for food packaging. This is a significant step toward environmental sustainability in the food industry, subject to compliance with national safety standards notified by FSSAI.

Labelling and e-commerce compliance

Starting from 2025, FSSAI established July 1 as a fixed annual enforcement date for all changes to labelling and display regulations. This gives businesses a predictable compliance calendar. FSSAI has also strengthened oversight of e-commerce food businesses, directing online platforms to ensure a minimum 45-day shelf life for food items sold through their channels. Additionally, proposed amendments aim to mandate bolder and larger font sizes for declaring the percentage of recommended daily allowance (%RDA) of added sugar, saturated fat, and sodium on food labels.

Stricter standards for allergens, trans fats, and traceability

FSSAI’s evolving guidelines also include tighter limits on trans fat content in processed foods, mandatory labelling of common allergens (peanuts, tree nuts, wheat, soy, dairy, shellfish), enhanced traceability norms for recall mechanisms, and stricter pesticide residue limits on fresh and processed foods. A draft amendment in 2025 also proposed regulations for vegan food imports, requiring certification from the exporting country’s authority.

Foreign food manufacturing facility registration

FSSAI has also moved toward requiring mandatory registration of foreign food manufacturing facilities for the import of high-risk categories like milk products, meat products, egg powder, infant food, and nutraceuticals. After extensions, the effective implementation date was set for September 2024, marking a stricter approach toward imported food safety.

Challenges in implementation

Despite the strong legal framework, the FSS Act faces implementation challenges. A significant portion of India’s food sector is unorganised – petty manufacturers, street food vendors, and small retailers are technically exempted from the FSSAI licensing requirement, yet they contribute greatly to food consumption, especially among lower-income populations. There is also a shortage of qualified food safety officers and enforcement staff in many states. The number of NABL-accredited food testing laboratories remains limited compared to the scale of food businesses operating in the country. Strengthening infrastructure, expanding lab capacity, and increasing the workforce remain ongoing priorities.

The broader significance of the FSS Act

The Food Safety and Standards Act, 2006 represents a fundamental shift in how India approaches food regulation. By moving from a punitive, reactive system under the old Prevention of Food Adulteration Act to a preventive, standards-based approach, the FSS Act emphasises self-compliance by food businesses alongside government oversight. It aligns India’s food safety framework more closely with international norms (India is a WTO signatory and participates in Codex Alimentarius processes), which supports both public health domestically and India’s position in global food trade.

The Act’s combination of science-based standard-setting, mandatory licensing, graded penalties, and consumer compensation provisions creates a comprehensive ecosystem designed to ensure that food on Indian plates – whether from a local vendor or a multinational manufacturer – is safe and fit for consumption.
