India is home to some of the world’s richest ecosystems – from the snow-capped Himalayas to the tropical Western Ghats. Yet, the country also faces some of the most severe environmental challenges on the planet. Rapid industrialisation, a growing population exceeding 1.4 billion, and decades of development-focused policies have put immense pressure on India’s natural resources. Understanding how India has responded to these challenges – through laws, institutions, and grassroots movements – is essential for anyone studying environmental management today.

Historical roots of environmental awareness in India

Environmental consciousness in India is not a modern invention. Ancient Indian texts such as the Vedas, Ramayana, Mahabharata, and Arthashastra contain numerous references to the protection of trees, water, animals, and land. Kautilya’s Arthashastra, composed between 321 and 300 BCE, outlined specific regulations for forest protection, water conservation, wildlife protection, and pollution control – provisions that would be considered progressive even today.

During the Mauryan period, Emperor Ashoka’s 5th Pillar Edict conveyed his views on the well-being of all beings in the kingdom. However, this tradition of ecological stewardship shifted dramatically during the colonial era. The British introduced formal environmental legislation, but it primarily served imperial economic interests – the Indian Forest Acts of 1865 and 1878 established state ownership over forests mainly to secure timber for railway expansion.

Post-independence developments

After independence, India’s priorities centred on economic development and poverty reduction. Environmental concerns took a back seat during the early Five Year Plans. The turning point came in 1972. The Stockholm Conference on Human Environment was a watershed event – the findings by Indian delegates shocked even the most pro-development advocates in the country. This conference became the catalyst for a series of environmental measures in India.

In response to the Stockholm Declaration, India established the National Council for Environmental Policy and Planning in 1972, which later became the Ministry of Environment and Forests (MoEF) in 1985, and was eventually renamed the Ministry of Environment, Forest and Climate Change (MoEFCC) in 2014.

Grassroots movements also played a critical role. The Chipko movement of the 1970s, where Himalayan communities – led primarily by women – physically embraced trees to prevent commercial logging, became a defining moment for Indian environmentalism. India’s environmental policy took concrete shape in the 1970s and 1980s when environmental obligations were included in the Constitution and federal laws were framed.

Key environmental issues facing India

India’s environmental challenges are vast and interconnected. Three of the most pressing issues are air and water pollution, deforestation, and biodiversity loss.

Air pollution

Air quality in India is among the worst globally. A 2024 report by IQAir found that 11 of the 20 most polluted cities in the world are in India. India’s average PM2.5 concentration in 2024 was 50.6 ยตg/mยณ – nearly 11 times higher than the WHO annual guideline of 5 ยตg/mยณ.

The sources of this pollution are well documented. Industrial activity is estimated to account for 51 percent of the country’s air pollution. Other major contributors include vehicle emissions, crop residue burning (particularly in Punjab and Haryana every October-November), coal-fired power plants, and construction dust.

The health toll is staggering. According to a Lancet Commission study, pollution caused 2.3 million deaths in India in 2019 alone, with nearly 1.6 million deaths attributed to air pollution. On average, air pollution reduces life expectancy in India by five years, and in Delhi, this figure rises to up to 12 years.

Water pollution

Water pollution is a major environmental issue in India – nearly 70% of surface water is unfit for consumption, and 163 million Indians lack access to safe drinking water. The largest contributor is untreated sewage. Urban areas generated 72,368 million litres per day of sewage in 2020-21, but only about 28% of it was treated – the remaining 72% was discharged directly into water bodies.

The Central Pollution Control Board (CPCB) reports that more than 350 river stretches across the country are polluted. Industrial effluents, agricultural runoff containing fertilisers and pesticides, and even cultural practices such as idol immersion contribute to the contamination. India’s environmental degradation is estimated to cost approximately US$80 billion annually, and water pollution alone has the potential to halve GDP growth.

Deforestation

Despite afforestation efforts, India’s primary forests continue to shrink. In 2024, India lost approximately 18,200 hectares of irreplaceable primary forest, according to Global Forest Watch data. Since 2001, India has lost approximately 2.31 million hectares of tree cover – a 7.1% decrease from levels in 2000.

The northeastern states have been disproportionately affected – Assam, Mizoram, Arunachal Pradesh, Nagaland, and Manipur collectively accounted for 60% of India’s total tree cover loss between 2001 and 2023. The main drivers include agricultural expansion, infrastructure development, and illegal logging.

On a somewhat positive note, India has advanced to the 9th position worldwide in total forest area according to the FAO’s Global Forest Resources Assessment 2025, and it maintains the 3rd position globally in annual net forest gain. However, experts caution that plantation forests cannot replace the ecological value of old-growth primary forests.

Biodiversity loss

India is one of the world’s 17 megadiverse countries, hosting about 8% of global biodiversity. Yet this richness is under severe threat. India ranked among the bottom five performers globally in the 2024 Nature Conservation Index, with a high rate of land conversion – 53% for urban, industrial, and agricultural purposes.

Research by the Indian Institute of Remote Sensing found a massive increase in urbanisation in the Western Himalayas alongside deforestation and a decline in water bodies and glaciers. In areas like Uttarakhand’s Nainital district, studies revealed an 11% decline in natural forest cover between 1991 and 2023, with a 27% loss of biodiversity attributed to unplanned urban growth.

Government initiatives and environmental legislation

India has built a comprehensive legal framework for environmental protection over the past five decades. This framework includes landmark legislation, specialised agencies, and national missions.

Constitutional provisions

The 42nd Amendment to the Constitution in 1976 introduced two key provisions – Article 48A directs the State to protect and improve the environment and safeguard forests and wildlife, while Article 51A(g) imposes a fundamental duty on every citizen to protect the natural environment. These articles provide the constitutional foundation for all environmental legislation in India.

The Environment (Protection) Act, 1986

This is India’s most important piece of environmental legislation. The EPA was enacted under Article 253 of the Constitution to fulfil commitments made at the Stockholm Conference, and the 1984 Bhopal Gas Tragedy – one of the world’s worst industrial disasters – highlighted critical regulatory gaps that accelerated its passage.

The Act contains 26 sections that empower the Central Government to set pollution control standards, and over time it has expanded to cover Coastal Regulation Zones, Environmental Impact Assessment, and waste management rules. It functions as an “umbrella legislation” that coordinates the work of central and state authorities.

Key powers under the Act include the authority to set environmental quality standards, restrict industrial operations in certain areas, lay down procedures for handling hazardous substances, and prescribe penalties for violations including fines and imprisonment.

Other landmark environmental laws

India’s environmental legal framework extends well beyond the EPA. The major statutes include:

Wildlife (Protection) Act, 1972: This legislation established a comprehensive framework for wildlife conservation, including provisions for protected areas such as national parks and wildlife sanctuaries. India now has 106 national parks, 573 wildlife sanctuaries, 115 conservation reserves, and 220 community reserves.

Water (Prevention and Control of Pollution) Act, 1974: This was India’s first specific anti-pollution law, establishing the Central Pollution Control Board (CPCB) and State Pollution Control Boards (SPCBs) to monitor and regulate water quality across the country.

Forest (Conservation) Act, 1980: This Act implemented strict controls on the conversion of forest land for non-forest purposes, requiring prior approval from the central government.

Air (Prevention and Control of Pollution) Act, 1981: This established the regulatory framework for air quality management. It expanded the mandate of the existing pollution control boards to address air pollution from industries and other sources.

Biological Diversity Act, 2002: Born out of India’s commitment to the UN Convention on Biological Diversity (1992), this Act aims to conserve biological resources and associated knowledge while facilitating sustainable access. It established the National Biodiversity Authority in Chennai for implementation.

The National Green Tribunal

The National Green Tribunal (NGT), established in 2010, is a specialised judicial body equipped solely for adjudicating environmental cases in the country. India is one of only a few countries with a dedicated environmental court.

The NGT has jurisdiction over all civil cases involving substantial environmental questions, and its orders are binding – with enforcement powers equivalent to those of a civil court. It handles cases under several key environmental laws including the Water Act, Air Act, EPA, Forest Conservation Act, and Biological Diversity Act. Individuals can approach the NGT directly without needing to engage an advocate.

National missions and recent programmes

Beyond legislation, India has launched several action-oriented programmes. The National Clean Air Programme (NCAP), launched in 2019, set the target of reducing particulate matter pollution in cities by 40% from 2017 levels by 2026.

The National Mission for Green India, launched in 2014, aims to expand forest and tree cover by 5 million hectares and improve quality on another 5 million hectares of forest and non-forest lands. The Namami Gange Programme has received billions of dollars in investment to rejuvenate the Ganga river and its tributaries.

The key factors influencing India’s environmental policy over the decades have been international diplomacy, political leadership, judicial activism, civil society advocacy, and environmental disasters. The Indian Supreme Court has also played an active role, expanding environmental rights through landmark judgements and directing governments to create new authorities and policies.

The road ahead

India faces a fundamental tension: balancing the development needs of its massive population with environmental sustainability. With 53% of land converted for urban, industrial, and agricultural use, and persistent challenges in enforcing existing regulations, the gap between policy and implementation remains significant.

Enforcement remains the weakest link. Although the government has pollution control boards and legislation in place, enforcement of regulations has been challenging and has had limited impact. Understaffed regulatory bodies, corruption, and the economic pressure to prioritise growth over conservation continue to undermine environmental protection efforts.

However, there are reasons for cautious optimism. Growing public awareness, an increasingly active judiciary, vibrant civil society organisations, and India’s commitments under international agreements like the Paris Climate Accord are all pushing environmental governance forward. The challenge is translating these commitments into measurable outcomes on the ground.
