Every year, India’s coal-fired thermal power plants produce millions of tonnes of fly ash, a fine powder byproduct of coal combustion. The MoEFCC’s draft notification sets an ambitious goal: 100% utilization of fly ash from coal and lignite-based thermal power plants. Recognizing that achieving this target requires time and infrastructure development, the notification extends the deadline by three to five years for complete fly ash utilisation. This extension acknowledges the practical challenges power plants face in developing markets, transportation networks, and utilization pathways for their ash.
Perhaps most significantly, the notification grants a 10-year extension for utilizing legacy ash, the accumulated ash stored before the publication of these regulations. This legacy ash represents years of stockpiled material sitting in ash ponds and dumps. The extended timeline gives thermal power plants a realistic pathway to progressively reduce these mountains of accumulated waste while managing newly generated ash.
The notification also introduces flexibility in how ash storage areas can be reclaimed. Areas where fly ash has been stored can now be transformed through plantations or by installing solar and wind power generation facilities, effectively converting former waste sites into productive land.
Penalties and the polluter pays principle
To ensure compliance, the notification incorporates financial penalties based on the polluter pays principle. Plants that fail to meet utilization targets face fines, with collected amounts deposited into designated Central Pollution Control Board accounts. These funds are then specifically earmarked for the safe disposal of unutilized ash, creating a circular system where non-compliance directly funds environmental remediation.
Mandatory stock disclosure and infrastructure requirements
Transparency forms a cornerstone of the new regulations. Thermal power plants must publicly disclose their ash stock details on a monthly basis. This requirement ensures that regulators, construction agencies, and the public can monitor ash generation and utilization rates in real-time, creating accountability and enabling better planning.

For distances between 100 and 300 kilometers, costs are shared equally between the thermal power plant and the construction agency. This balanced approach ensures that neither party bears an unfair burden while still incentivizing fly ash use over longer distances.
The notification also requires thermal power plants to monitor heavy metals like mercury in bottom ash and effluents. This environmental safeguard ensures that fly ash utilization doesn’t inadvertently create new pollution problems, particularly when ash is used in applications like mine void filling or agricultural land reclamation.
Dispute settlement mechanisms
Smooth fly ash transportation and utilization requires cooperation between multiple stakeholders including power plants, construction agencies, brick manufacturers, and government departments. To prevent conflicts from disrupting ash supply chains, the notification mandates that thermal power plants establish dispute settlement committees.
These committees typically include plant general managers and representatives from ash user associations. Their role is to resolve disagreements quickly, whether they involve ash quality concerns, transportation scheduling, or payment disputes. By providing a structured forum for addressing issues, these committees help maintain uninterrupted fly ash flow from plants to end users.
Mandatory use in construction projects
Perhaps the most impactful provision of the notification is the mandatory use requirement. All construction agencies, both public and private sector, located within a 300 kilometer radius of a thermal power plant must use fly ash-based products in their projects. This requirement creates guaranteed demand for fly ash, transforming it from an optional alternative material into a mandated component of regional construction.
This rule applies across various construction activities including road building, housing projects, commercial developments, and infrastructure works. Fly ash can be incorporated into cement production, used in manufacturing bricks and blocks, applied in road construction and embankments, and even utilized for mine void reclamation.
The environmental benefits are substantial. Fly ash bricks, for example, don’t require topsoil, helping preserve agricultural land. They also reduce the need for firing bricks in kilns, cutting greenhouse gas emissions. When used in cement, fly ash can replace a portion of clinker, reducing the carbon footprint of cement production.
Enforcement through agreements and certifications
Regulations are only as effective as their enforcement mechanisms. The notification places responsibility on state authorities to ensure that Memoranda of Understanding (MoUs) are established between thermal power plants and construction agencies within the 300 kilometer radius. These MoUs formalize the relationship, specifying quantities, quality parameters, delivery schedules, and responsibilities.
For road construction projects specifically, the notification introduces a clever compliance tool: contractors will only receive payment upon submission of a fly ash utilization certificate from the thermal power plant. This payment linkage creates a powerful incentive for contractors to actually use fly ash rather than simply agreeing to do so on paper. The thermal power plant, in turn, verifies that ash was supplied and used appropriately before issuing the certificate.
This certification system creates a closed loop of accountability. Contractors need the certificate to get paid, power plants need to supply ash to issue certificates, and government departments overseeing projects can easily verify compliance through simple documentation checks.
Real-world implementation and challenges
Organizations like the National Thermal Power Corporation (NTPC) demonstrate what successful fly ash management looks like in practice. NTPC has installed rail loading facilities at multiple power plants to enable bulk transportation of fly ash to cement manufacturers hundreds of kilometers away. The company supplies millions of tonnes of fly ash annually for road construction, manufactures fly ash bricks at its own facilities, and has pioneered techniques like using ash for mine void reclamation and developing fly ash-based geo-polymer concrete roads.
However, challenges remain. Creating consistent market demand for fly ash products requires overcoming perceptions about quality and performance. While fly ash bricks are often stronger and more durable than traditional clay bricks, many builders remain unfamiliar with them. Price regulation through Department Schedule Rates can sometimes discourage manufacturers, particularly when these rates haven’t been updated to reflect current market conditions.
Transportation infrastructure also needs expansion. While railway wagon transport offers a cost-effective solution for long distances, not all power plants have rail connectivity. Road transport works for shorter distances but becomes prohibitively expensive beyond 100-200 kilometers. Developing a robust transportation network that can efficiently move ash from power plants to construction sites across the country remains an ongoing challenge.
The path toward circular economy
The MoEFCC fly ash utilisation notification represents more than just waste management regulation; it embodies a circular economy approach where industrial byproducts become valuable resources. By mandating utilization, sharing transportation costs, requiring infrastructure development, and linking payments to compliance, the notification creates a comprehensive system that addresses both the supply and demand sides of the fly ash equation.
Success will depend on sustained commitment from all stakeholders. Thermal power plants must invest in infrastructure and actively market their ash. Construction agencies need to overcome hesitations and embrace ash-based materials. State governments must enforce regulations consistently and ensure that MoUs translate into actual implementation. Research institutions should continue developing innovative applications for fly ash, from agricultural soil amendments to advanced construction materials.
As India continues to rely on coal for a significant portion of its electricity generation, effectively managing the resulting fly ash will remain a critical environmental priority. The MoEFCC notification provides a framework, but transforming this framework into reality requires determination, innovation, and collaboration across the power sector, construction industry, and regulatory agencies.
